By creating an account, accessing our website, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Eligibility

To use our Services, you must:

• If you are between 13 and 18 years old, you must have parental or guardian consent to use our Services

• Other AI-based creative content tools

5. Subscription Plans and Payment

5.1 Free and Paid Plans

• Free Plan: Limited features and usage restrictions apply
• Paid Subscriptions: Monthly subscription plans with enhanced features and increased usage limits

5.2 Payment Terms

• Payments are processed securely through Stripe
• Subscription fees are billed monthly in advance
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for the subscription fees

5.3 Automatic Renewal

• Subscriptions automatically renew at the end of each billing cycle
• You may cancel your subscription at any time through your Stripe account or contacting with us
• Cancellations take effect at the end of the current billing period
• No refunds are provided for partial billing periods

5.4 Price Changes

We reserve the right to modify subscription prices with at least 30 days' notice. Continued use of the Services after the price change constitutes acceptance of the new pricing.

6. Acceptable Use Policy

6.1 Permitted Use

You may use our Services only for lawful, personal, and non-commercial purposes.

6.2 Prohibited Conduct

You agree NOT to:

• Upload images of individuals without their consent
• Upload images of minors (under 18 years old)
• Create, upload, or distribute content that is:
  • Illegal, harmful, threatening, abusive, or harassing
  • Defamatory, obscene, pornographic, or sexually explicit
  • Discriminatory based on race, gender, religion, nationality, disability, or sexual orientation
  • Infringes on intellectual property rights or privacy rights of others
• Use our Services to create deepfakes or misleading content intended to deceive or harm others
• Attempt to reverse engineer, decompile, or hack our Services
• Use automated bots, scripts, or tools to access our Services
• Resell, redistribute, or commercially exploit our Services without authorization
• Interfere with or disrupt the integrity or performance of our Services

7. Intellectual Property Rights

7.1 Your Content

• You retain all ownership rights to images you upload ("Your Content")
• By uploading Your Content, you grant Pixivo a limited, non-exclusive license to process and generate AI content based on your uploads
• This license terminates when Your Content is automatically deleted (within 30 minutes)

7.2 AI-Generated Content

• You own the AI-generated images and videos created using our Services
• Pixivo does not claim ownership of AI-generated outputs
• However, you acknowledge that AI outputs may not be eligible for copyright protection in some jurisdictions

7.3 Pixivo's Intellectual Property

• Our website, logo, branding, AI models, and technology are owned by Pixivo Limited
• You may not copy, modify, distribute, or create derivative works without our written permission

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Basis

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Accuracy, reliability, or quality of AI-generated content
• Uninterrupted or error-free service

8.2 AI Limitations

You acknowledge that:

• AI-generated content may contain inaccuracies or artifacts
• Results may vary based on input quality and other factors
• We do not guarantee specific outcomes or satisfaction with generated content

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Pixivo Limited, its directors, employees, and affiliates shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Damages arising from your use or inability to use our Services

Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pixivo Limited and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of our Services
• Your uploaded content or AI-generated content
• Your violation of any third-party rights

You may terminate your account at any time by:

• Following the account deletion process in your account settings

10.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if you:

• Violate these Terms
• Engage in prohibited conduct
• Fail to pay subscription fees
• Engage in fraudulent or illegal activity

10.3 Effect of Termination

• Upon termination, your access to the Services will cease immediately
• No refunds will be provided for remaining subscription periods
• We will delete your account data in accordance with our Privacy Policy

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

11.2 Jurisdiction
